1. Agreement to terms

These Terms of Use ("Terms" or "EULA") constitute a legally binding End User License Agreement between you and Lynden-Blaine Technologies Inc., a Delaware corporation ("Company," "we," "us," or "our"), concerning your access to and use of SkyPad—including our mobile application, website (such as skypad.app), and related services (collectively, the "Service").

BY ACCESSING OR USING THE SERVICE, YOU AGREE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, YOU MAY NOT ACCESS OR USE THE SERVICE.

2. Eligibility

You must be at least 13 years of age to use the Service. If you are under 18, your parent or legal guardian must review and agree to these Terms on your behalf.

3. Service description

SkyPad is a digital notebook and workspace for aviation: structured note-taking, aviation-specific templates, built-in utilities (planning, calculations, visualization, and similar tools), and syncing across supported devices—for students, instructors, and flight schools. The Service is not an air traffic control (ATC) simulator, a radio training course, or a scored “exercise” or “exam” product. Optional text-based AI assistance or other in-app helpers may be offered to support your workflow (for example, drafting or organizing content); any voice features, if provided, are for convenience (such as dictation)—not for operational ATC communications. SkyPad supplements ground study and organization; it does not replace certified flight instruction, your CFI, or official publications. The Service may include:

  • • Notebooks, templates, diagrams, and content you create—stored and synced as described in-app
  • • Aviation-oriented tools and interactive elements for instruction, briefing, and study
  • • Optional AI-assisted features (primarily text-based) and optional voice input where we offer them
  • • Account, sync, and product features that may change as we improve SkyPad

4. Subscription and payment terms

4.1 Subscription plans

SkyPad may offer free and paid tiers. Plan names, prices, billing periods, and what each tier includes (storage, sync, AI allowances, premium tools, etc.) are shown in the Apple App Store, Google Play Store, or inside the Service at the time you subscribe. If anything in these Terms conflicts with the store listing or in-app description at purchase, the store listing and in-app description control for that transaction.

4.2 Fair use and platform limits

We may apply reasonable technical or usage limits to keep SkyPad reliable for everyone—for example, caps on automated requests, AI or API usage, storage, sync traffic, or other resource-heavy behavior. Limits may be described in-app. We may throttle, cap, or suspend access that unreasonably degrades the Service, appears automated or abusive, or circumvents intended use.

4.3 Payment processing

All payments are processed through the Apple App Store or Google Play Store. Subscriptions automatically renew unless canceled at least 24 hours before renewal.

4.4 Refund policy

All sales are final. We do not provide refunds except as required by law or the applicable app store's refund policy.

5. Acceptable use policy

The Service is intended solely for individual, personal, non-commercial use. You may NOT:

  • • Use the Service for commercial training without an Enterprise license
  • • Share account credentials or create multiple accounts
  • • Use automated tools, bots, or scripts
  • • Reverse engineer or decompile the Service
  • • Circumvent usage limits or security measures
  • • Interfere with service quality for other users

6. Intellectual property

All content, features, and functionality in the Service are the exclusive property of Lynden-Blaine Technologies Inc. and are protected by copyright, trademark, and other intellectual property laws.

7. Disclaimers

  • Educational tool only: Not a substitute for official aviation training or certification
  • No aviation authority endorsement: Not affiliated with FAA, ICAO, or any aviation authority
  • Not for operational use: Must not be used for actual flight operations
  • AI limitations: Optional AI-generated text or suggestions may be wrong, incomplete, or unsuitable; you remain responsible for your training decisions and official sources
  • "As is" service: Provided without warranties of any kind

7.1 Aeronautical diagrams and information — not for navigation

The Service may display or reference airport diagrams, runway layouts, taxiway configurations, and other aeronautical or chart-like information (collectively, "Diagram Content") solely for illustration, note-taking, and educational purposes within SkyPad. Such Diagram Content is provided for planning and study workflows in the app only and must NOT be used for navigation or for any actual flight operations. Diagram Content may be simplified, outdated, incomplete, or inaccurate and does not constitute an official or current source of aeronautical information. You must not rely on any Diagram Content for preflight planning, in-flight navigation, or any operational decision. For actual flight operations, you must use only current, official publications and charts issued by the relevant aviation authority (e.g., the Federal Aviation Administration, national aviation authorities, or other authorized chart providers). To the maximum extent permitted by law, we disclaim all liability for any loss, injury, or damage arising from any use of or reliance on Diagram Content for navigation or operational purposes.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LYNDEN-BLAINE TECHNOLOGIES INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE TWELVE (12) MONTHS PRECEDING THE EVENT OR $100, WHICHEVER IS GREATER.

9. Termination

We may suspend or terminate your access immediately for violation of these Terms, abusive or illegal use, or conduct that threatens the Service or other users. You may terminate by canceling your subscription and discontinuing use.

10. Governing law

These Terms are governed by the laws of the State of Delaware, United States. Disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules.
